Notify with a defined scope
Civil Code article 1122 prohibits individual works that damage common parts or prejudice stability, safety or architectural appearance. It also requires prior notice to the administrator, who reports to the assembly. The practical starting point is a description that lets the administrator and technician understand what will actually change.
Include the flat identifier, a plan or marked scope, the proposed period, contractor contact and expected effects on shared installations. Do not describe a drain move simply as “new bathroom”. If the design changes after notice, send an updated description through the agreed channel. Keep evidence of the notification and any response with the project.
Separate the decisions that belong to different people
| Question | Who helps resolve it | Evidence to retain |
|---|---|---|
| Is the intervention technically and legally suitable? | Qualified tecnico and relevant specialists | Assessed scope and design |
| Is common property or an external appearance affected? | Tecnico, administrator and any required decision-makers | Identified rights, applicable agreement or resolution |
| Which building filings or other consents apply? | Tecnico and the competent public authority | Required filings and consents |
| How will the contractor use the building? | Administrator, owner and contractor | Written logistics arrangements |
Prior notification is not blanket permission to alter a shared stack, structural wall or façade. Equally, do not assume every private interior job needs the same assembly vote. Ask which rights, building rules and decisions apply to the precise intervention. An administrator’s informal reassurance is not a structural design or a substitute for a public filing.
Check the actual local route, such as the Milan SUE portal, with the technician. A building’s acceptance of carrying materials through its entrance does not establish the renovation’s planning compliance.
Survey the shared-service boundary
Ask the plumber to mark the private branch and proposed connection to the existing stack. Identify shut-off points, access panels and the area that has to be opened. If shared water or heating must be interrupted, arrange the authorised person, notice to occupants and reinstatement checks. The timing belongs in the programme before demolition, not in an urgent call after a pipe has been cut.
For new or altered installations, the contractor’s DM 37 declaration needs an identified scope and compatibility with retained systems. Obtain the existing information available from the building, but ask the installer to assess the actual connection. A photocopy of an old building certificate does not document your new private branch.
Agree the route from the street to the flat
- Measure the entrance, stairs, lift and route for long or heavy items.
- Confirm permitted lift use, load limits and the protection arrangement with the responsible operator.
- Record baseline photographs of the agreed carrying route and retained common finishes.
- Agree where materials and waste may wait, without obstructing escape or access.
- Check deliveries, parking or occupation of public space separately from building permission.
- Confirm working hours from the applicable rules and any procedure for unusually noisy work.
Put these conditions into the contractor’s price. “Delivery included” may mean arrival at the kerb rather than carrying to an upper floor. Ask how a failed delivery, broken lift or unavailable booking affects labour, storage and timing. Any contingency for access should have an owner and a response plan.
Distinguish actual cost from a refundable deposit
| Item | Cash amount |
|---|---|
| Lift and route protection | 250 |
| Agreed shutdown attendance | 100 |
| Provisional street/delivery arrangement | 200 |
| Additional carrying | 350 |
| Refundable damage deposit under an explicit agreement | 500 |
| Cash needed initially | 1 400 |
| Expected final cost if deposit returned in full | 900 |
The €500 deposit needs temporary funding and a recorded recipient, return conditions and reconciliation date. It is not €500 of final construction expense when returned intact. If €120 is later retained for an accepted documented charge, the final logistics cost becomes €1,020 and the returned deposit €380. Do not enter both the whole deposit and the same €120 as permanent cost.
Keep the site organisation and close-out clear
Article 90 of D.Lgs. 81/2008 addresses client duties and coordination where relevant companies are involved; article 99 identifies preliminary-notification cases. The administrator does not automatically become your safety coordinator. Ask the professional to assess the actual contractor/subcontractor structure and define who has each appointment and responsibility.
Adapt the outline to the real project and required channel; it is an organisational example, not a legal authorisation. At completion, inspect the carrying route, restore protection and access, reconcile the deposit and obtain relevant shared-service records. Keep the agreed arrangements, costs and recorded payments together in Reno Pro so that a finished flat does not leave an unresolved building dispute.
